AN ORDINANCE PROVIDING FOR A COMPREHENSIVE CODE FOR THE YOUTH IN NAGA CITY AND OTHER PURPOSES AND PROVIDING FUNDS THEREOF:-

EXPLANATORY NOTE
WHEREAS, as mandated by ARTICLE II, Section 13 of our 1987 Constitution, the State shall recognize the vital role of the youth in nation-building and shall promote and protect their physical, moral, spiritual, intellectual, and social well-being and shall inculcate in the youth patriotism and nationalism, and encourage their involvement in public and civic affairs;
WHEREAS, Republic Act 8044 otherwise known as the “Youth in Nation-Building Act” was enacted to give recognition to the youth’s responsibility to fulfill their vital role in nation-building;
WHEREAS, the development of the youth sector in the City of Naga is one of the priorities of the City Government in terms of the protection of their rights, promotion of their general welfare, as well as youth participation and development;
WHEREAS, to realize the city’s vision of providing a youth-friendly environment for improving the quality of life of its youth sector, there is a need for the Sangguniang Panlungsod to enact an ordinance that will uphold the rights and ensure the promotion of general welfare of its youth and their protection from acts, conditions, or influences that are prejudicial to their development, and which shall set the guidelines for ordinances pertaining to the City’s youth sector;
NOW THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of Naga, that:
ARTICLE I – TITLE, POLICY, PRINCIPLES AND DEFINITION OF TERMS
SECTION 1. - TITLE. – This ordinance, for brevity, shall be known as the “Naga City Youth Code”.
SECTION 2. - POLICY. – The State recognizes the vital role of the youth in nation-building and shall promote and protect their physical, moral, spiritual, intellectual, and social well-being. It shall inculcate in the youth patriotism and nationalism, and encourage their involvement in public and civic affairs.
SECTION 3. – RELATED AND GUIDING PRINCIPLES.
(a) The rights of the youth as stipulated in the Constitution and other laws shall be upheld at all times;
(b) Every youth has the right to be informed of his inherent rights as stipulated in the Constitution and other related laws;
(c) Every youth has the right to bodily integrity and to the means necessary for the proper development of life, particularly food, clothing, shelter, medical care, rest, and, finally, the necessary social services;
(d) Every youth has the right not to be discriminated, intimidated, abused, or humiliated;
(e) Every youth has the right to quality and responsive education;
(f) Every youth has the right to freely and fully participate in the political processes of his community and country;
(g) Every youth has the right to economic development based on the precepts of justice and equity;
(h) Every youth right is coupled with a moral and legal obligation that he should fulfill;
(i) Every youth has the right to exercise freedom of religion.
SECTION 4. - DEFINITION OF TERMS.
(a.) YOUTH by virtue of Republic Act 8044 otherwise known as The Youth in Nation-Building Act of 1995, and for the purpose of this ordinance, shall refer to those persons whose ages range from fifteen (15) to thirty (30) years old, which shall include but not limited to the following: Sangguniang Kabataan Members, Naga City Youth Officials, 4H Club Youth members, Youth Organizations United for Naga groups (youngs), Out-of-school youth (OSY’s), and all other youth organizations duly organized and recognized by the Barangay level.
(b.) Youth of School Age shall refer to all youth whose ages range from 15-25 years.
(c). Minor youth shall include all youth whose ages range from 15-17 years.
(d.) Working youth shall refer to all youth whose ages range from 18-30 years who are employed either on a regular or temporary basis.
(e). OUT-OF-SCHOOL YOUTH refers to all youth of school age, whether organized or not, who are unable to avail of the formal school system or who have dropped out from formal elementary and secondary education.
(f). IN-SCHOOL YOUTH refers to all youth of school age, whether organized or not, presently enrolled with any educational, vocational institution which include but not limited to the following school organizations (academic or non-academic), student government, fraternities and sororities.
(g) SPECIAL YOUTH refers to youth with disabilities or those who suffered physical defects, as well as youth with special needs which include but not limited to those who are drug dependents, in conflict with the law, and those caught in armed conflicts.
(h). COMMUNITY YOUTH ORGANIZATIONS are organizations whose majority of membership are youth and might be based in educational institution but whose program are not solely for educational advancement or may be community based whose members are not all out-of-school youth.
(i). CIVIL RIGHTS are those rights of the youth to be protected against all forms of abuse, exploitation and discrimination in situations where the youth is considered in extremely difficult circumstance.
(j). ECONOMIC, SOCIAL, AND CULTURALRIGHTS pertain to the access of the youth to educationalopportunities, relevant information, leisure, cultural activities and the right tofreedom of thought, conscience and religion.
(k). POLITICAL RIGHTS are those rights which provide the youth the freedom to express themselves on matters affecting his or her life.
(l). Anti-Social Related Activities are those acts against property, chastity and person which include but are not limited to the following:
Petty crimes such as snatching, shoplifting, misrepresentations;
1. Using and pushing prohibited drugs;
2. Selling or distribution of lewd/obscene reading materials;
3. Pimping for young and adult prostitutes, sexual perversions and doing or participating in obscene shows;
4. Gambling of any form;
5. Rape and incest; and
6. All other circumstances as defined in the existing laws.
(m). Hazing shall mean an initiation rite being conducted as a prerequisite for admission as member in a fraternity, sorority, or organization by placing the recruit, neophyte, or applicant in an embarrassing or humiliating situation such as forcing him/her to do menial, silly foolish, and other similar tasks or activities, or otherwise subjecting him/her to physical suffering or injury.
SECTION 5. - A comprehensive program for the youth shall be formulated, within one (1) year from the effectivity of this Code by the Naga City Council for Youth Development, after consultation with the Sangunniang Kabataan, City Youth Officials, youth groups, other government agencies, private sector, and non-government organizations.
SECTION 6. – CREATION OF THE NAGA CITY COUNCIL FOR YOUTH DEVELOPMENT (NCCYD) WITH ITS COMPOSITION, DUTIES AND FUNCTIONS. The Naga City Council for Youth Development (NCCYD) shall be created to formulate plans that will promote the development and uphold the rights of the youth of the city.
SECTION 6-1. – COMPOSITION OF THE NAGA CITY COUNCIL FOR YOUTH DEVELOPMENT. The NCCYD shall adopt the following composition:
a) The SK Federation President and the CYO Mayor shall be automatic members of the Council.
b) All accredited youth organizations shall be assembled through a congress and shall elect their sectoral representatives, two (2) from each sector:
- In-school youth
- Out-of-school youth
- Special youth
- Community youth
c) The SK Federation President will automatically be the Chairperson of the Council, and from among the representatives of the elected sectoral representatives, shall elect the:
- Co-chairman
- Secretary
- Treasurer
SECTION 6-2. – FUNCTIONS, DUTIES AND RESPONSIBILITIES OF THE NCCYD.Aside from the functions, duties, and responsibilities already mandated by the Local Government Code of 1991, the following duties, responsibilities, and functions shall be observed:
1. Formulate in consultation with all accredited youth organizations a City Youth Development Plan and monitor its implementation;
2. In consultation with all accredited youth organizations, develop the youth legislative agenda and advocate and/or lobby for its passage;
3. Facilitate city-wide training and seminars that will:
a) Enhance management and leadership capacities of the youth leaders;
b) Popularize the city youth development plan and youth legislative agenda;
c) Familiarize the youth of all the laws and policies that concerns them;
d) Sustain their respective organizational programs and projects.
4. Facilitate and monitor all activities pertaining to youth development;
5. Initiate advocacy workshops and programs on:
a) moral recovery;
b) anti-drug abuse;
c) new politics;
d) sustainable development; and
e) Climate Change Adaptation and Disaster Risk Reduction Management.
6. Create such other committees and bodies as it may deem necessary to attain its objectives;
7. Coordinate and link up with other agencies whether government or private for youth welfare and development;
8. Assist the city government in all developmental projects;
9. Undertake fund-raising and resource mobilization activities;
10. Other programs that are designed to enhance the social, political, economic, cultural, intellectual, moral, spiritual and physical development of the youth.
SECTION 6-3. – ROLES AND RESPONSIBILITIES OF OFFICERS. The first elected members of the council shall include the roles and responsibilities of the officers in the internal rules and procedures of the council as to have flexibility for the demand of the changing local condition and situation.
SECTION 6-4. – TERMS OF OFFICE
a) All sectoral representatives shall hold office during their incumbency for only 1 year upon election.
b) The terms of office of the SK Federation President and the CYO Mayor shall be until such time that their legal successors shall have been duly elected and qualified.
c) Each term of office will commence upon the assumption of office of newly elected city officials.
In order to uphold the non-partisan nature of the NCCYD, the selection process for the new Board and Officers of the council should be conducted 6 months prior to the assumption of office and will join the activities of current Board and Officers on observer status for easy transition.
SECTION 6-5. – COMMITTEES WITH THEIR RESPECTIVE DUTIES AND FUNCTIONS AND COMPOSITION. The NCCYD shall create and adopt the following committees which shall perform and oversee specific tasks of the Council.
A. ADVISORY COMMITTEE
a. An Advisory Committee shall be created to supervise and monitor the operation of the NCCYD.
b. The main role of the Advisory Committee is to review the following:
1. The operation plan and budget of the Council;
2. Internal rules and procedure of the Council;
3. Accreditation process and guidelines set forth by the accreditation committee.
c. The following are the members of the advisory committee:
- City Mayor as Chairperson
- The City Administrator
- City Planning and Development Office (CPDO)
- City Social Welfare and Development Office (CSWDO)
- Metro PESO
- Education, Sports, and Scholarship Office (ESSO)
B. ACCREDITATION COMMITTEE
a. An accreditation committee will be convened whenever necessary to act on all application for accreditation.
b. The Accreditation Committee shall be composed of the following:
- SK Federation President;
- NCPC Representative belonging in the youth sector;
- Representative from Education, Sports and Scholarship Committee;
- Representative from the City Social Welfare and Development Office;
- Representative from the National Youth Commission (NYC).
SECTION 6-6. – ACCREDITATION/REGISTRATION
a. Only those youth groups/organizations or associations which exist in the City of Naga shall be accredited by the council.
b. The requirements for accreditation/registration to the council are as follows:
- Letter expressing intent for accreditation and to join the NCCYD;
- Resolution requesting for accreditation/registration of the youth group/organization or association with their official and alternate representatives;
- Certification of existence and veracity of information submitted to the council from any of the following:
3.1 Office of the Student Affairs or any school administrators, for the in-school youth organizations.
3.2 Punong Barangay, DOLE, DSWD, DILG, DA, CDA, and DAR, for the out-of-school youth, special youth, and community youth organizations;
4. Constitution and By-Laws; if none, at least organizational policies and guidelines;
5. List of activities undertaken for the last 12 months with financial statement, except for newly established organizations;
6. Plan and budget of activities for the current year;
7. If S.E.C. registered, Certification from the Securities and Exchange Commission; and
8. List of officers and members.
c. To assist the youth organization in their accreditation, the SK Federation Office will provide accreditation forms to interested applicants for the first year of implementation of this ordinance and the NCCYD Office thereafter.
d. All documents should be forwarded to and received by the accreditation committee. Negative action of the committee on application can be appealed to the Sangguniang Panglungsod whose decision shall be deemed final and executory.
SECTION 6-7. – RIGHTS, DUTIES, AND OBLIGATIONS OF MEMBER OR ACCREDITED ORGANIZATIONS. Members or accredited youth organizations shall have the following rights:
1. The right to participate in all NCCYA activities;
2. The right to avail the services of the council;
3. The right to vote and if qualified, to be voted upon;
4. The right to use the facilities of the council.
The following are the duties and responsibilities of members or accredited youth organizations:
1. To actively participate in the activities of the council; and
2. To propagate by word and deed the principles, objectives, and programs of the council.
SECTION 6-8. – INCENTIVE. Any youth organization/association existing within Naga City who failed to register or accredit are not entitled to any benefit that the City may provide and are not entitled to representation in the Council.
SECTION 6-9. – DOMICILE. The Naga City Council for Youth Development (NCCYD) shall hold its office at the SK Federation Office and should have a separate staff whose sole concern is the day-to-day operation of the Council.
SECTION 6-10. – INTERNAL RULES AND PROCEDURES
a. The Internal Rules and Procedures shall be formulated by the first set of Board and Officers subject to consultation with all accredited youth organizations and approval of the Advisory Committee.
b. The internal Rules and Procedure shall provide for the following:
a. Regular and special meetings;
b. Quorum;
c. The order and calendar of business for each session;
d. Parliamentary procedures which shall include the conduct of all its members during the session;
e. Disciplinary actions;
f. The manner of approving resolutions;
g. Such other measures as the council may adopt.
SECTION 6-11. – NON-PARTISAN NATURE OF THE NCCYD. The Naga City Council for Youth Development (NCCYD) shall not allow itself to be used for the purposes of partisan politics and shall adopt measures to ensure that it is adequately shielded from any political partnership or influence.
ARTICLE II – CIVIL RIGHTS OF THE YOUTH
SECTION 7. – PROSTITUTION AND OTHER SEXUAL ABUSE. Any youth, whether male or female, who for money, profit or any other consideration or due to the coercionor influence of any adult, syndicate or groups, indulges in sexual intercourse or lasciviousconduct, is considered to be exploited in prostitution and other sexual abuse.
SECTION 8. - OBSCENE PUBLICATIONS AND INDECENT SHOWS. Any person whoshall hire, employ, use, persuade, coerce or force a youth, whether live or in video, to pose ormodel in obscene publications or pornographic materials shall be penalized according to existing laws penalizing such acts.
SECTION 9. - APPOINTMENT OF YOUTH RELATIONS OFFICERAND POLICE PROCEDURES. The Naga City Police Station may assign a YouthRelations Officer, preferably a female police officer, who will be tasked to handle cases involving the youth.
SECTION 10. - SPECIAL COURSES FOR PNP MEMBERS. A special course that deals with handling abused and delinquent youth shall be designed and obligatorilygiven to the members of Philippine National Police in Naga City. The Naga City Police Office together with the City Social Welfare and Development Office shall be tasked to design and initiate the conduct of training programs and/or seminars on the specialcourse.
SECTION 11. – Police brutality, being the state or quality of being harsh, ruthless,cruel, or unrelenting to a youth who is suspected of committing crime, misdemeanor or antisocialactivities during arrest, apprehension, investigation and interrogation or when applied to youth suspects under the custody of police authorities shall be prohibited and dealt withappropriate action from the People’s Law Enforcement Board (PLEB). Case or cases of brutality of police officer(s) committed against a youth offender shall be filed inPLEB who will determine the appropriate penalty or penalties without prejudice to the provisionsof the Revised Penal Code.
SECTION 12. – No person shall force, coerce, bully, or deceive any youth into joining any organization, fraternity, sorority, gang, or association. Any person caught in the act of forcing or deceiving any youth, or those who have forced and deceived the latter into joining any organization, fraternity/sorority, or gang within the campus or outside the school grounds will be sanctioned with four (4) hours of community service to the City Government if the offender is a fellow youth, or a fine of One Thousand Pesos (Php 1,000.00) and eight (8) hours of community service if the offender is an adult, without prejudice to filing of appropriate legal action.
(a). Recruiters from any organization or fraternity/sorority must secure permission from the parents/guardians of the minor youth being recruited.
(b). Hazing or initiation rites are discouraged, if not regulated, conforming to Republic Act 8049.
(c). If the youth subjected to hazing or other forms of initiation rites suffers any physical injury or dies as a result thereof, the officers and members of fraternity, sorority, or organization who actually participated in the infliction of physical harm shall be liable as principals and will suffer the sanctions as provided under Republic Act 8049.
SECTION 13. – It shall be the policy of the City Government to prohibit youth discrimination especially on the basis of gender and sexual orientation, social class, religion, and political affiliation.
ARTICLE III – ECONOMIC, SOCIAL, AND CULTURAL RIGHTS OF THE YOUTH
SECTION 14. - GENERAL FRAMEWORK. The development of the youth is determined by both external and internal factors, so that, it is the shared responsibility of theparents, siblings, and relatives which shall be known as the internal factor and the State, civilsociety, and community which shall be known as the external factor to provide the necessaryenvironment, support, assistance and other initiatives to make the youth responsive andproductive members of the society.
SECTION 15. - The Naga City government, representing the State, shall ensure, tothe maximum extent possible, the development of the youth by providing facilities,programs and projects for the purpose and at the same time facilitate and mobilize the civilsociety and the community to reinforce and strengthen the initiatives for the general welfare of the youth sector.
SECTION 16. - The Naga City government shall formulate policies, programs,projects and initiatives to contribute to the development of the youth.
SECTION 16-1. – EDUCATION POLICIES.
(a) The City Government of Naga shall allocate budget intended for the purpose of youth development and education.
(b) The Sangguniang Kabataan shall apportion funds for educational purposes in every barangay.
(c) The Raul S. Roco Library shall ensure that there are up to date educational materials and technologies that will cater to the needs of the youth.
(d) Information pertaining to governance, city projects, programs, activities, including information regarding fiscal matters shall be made accessible to the youth.
(e) The Raul S. Roco Library should have a program that would ensure that the youth would know the services that they provide.
SECTION 16-2. – ECONOMIC POLICIES.
(a) The City Government of Naga through its appropriate agency/office shall render technical and vocational trainings to interested youth that would help them acquire new skills, provide education and training to young entrepreneurs.
(b) The City Government shall forge ties with the private sector in order to provide financial assistance to youth individuals and organizations that are interested to start their own business or enter into financial enterprise.
(c) The City Government of Naga shall appropriate budget for business loans for youth entrepreneurs.
(d) The City Government shall prosecute the owners and cancel the business permit of institutions that would not provide a just compensation and/or benefit as mandated by law to its youth workers. It shall also require the business entity to comply within 30 days from the receipt of the complaint from the Office of the City Mayor.
(e) The City Government shall periodically check all businesses that employ youth and shall see to it that the working condition/environment is youth-friendly.
(f) The City Government shall ensure that no youth worker is deprived of job training, promotion, and compensation, benefit, on the basis of age, gender, ethnicity, creed, civil status, ideology, or political affiliation.
(g) Metro PESO shall periodically conduct job fairs and other activities having the same nature for the purpose of offering employment for the youth.
(h) The City Government, together with the NGO’s concerned, private and public offices, and other commercial and non-commercial establishments shall provide the youth opportunities for On-the-Job trainings.
SECTION 16-3. – HEALTHCARE POLICIES.
(a) The City Government of Naga through the Naga City Hospital shall provide check-ups and free health orientations to youth especially on health issues concerning them.
(b) The City Government shall provide counseling programs and services through the City Health Office regarding health issues concerning the youth.
(c) The City Government of Naga shall allocate budget that will cater to the health needs of the youth of the city.
(d) The City Government shall encourage/conduct periodic health symposium aimed in giving awareness to the youth sector of health issues and concerns that they have to learn.
(e) The City Health Office shall have programs that will teach and give information to the youth about sex education.
(f) Business institutions, regardless of their breadth, that is found out to be selling cigarettes and or liquors to minors shall be penalized according to existing ordinances which penalize such activities.
SECTION 16-4. – SPORTS DEVELOPMENT. The City Government of Naga shall establish an integrated youth and sports development program in order to discover and develop fresh would-be athletes from the youth sector who will someday represent the city in national level competitions, or who will become national athletes who will bring honor and glory for the city.
SECTION 17. – TRAINING FOR OUT OF SCHOOL YOUTH. The City Government shall conceptualize programs to promote the development of the Out-of-School Youth (OSY) to become self-reliant, economically productive, socially responsible citizens able to contribute to the development of the family and community. A technological institute may be established that will aim in training the OSY’s of the city in technological and vocational courses.
SECTION 18. – FOCUS ON SPECIAL YOUTH. The localgovernment of Naga City shall give special focus on special youth by implementingprograms and projects that will develop and enhance their skills and empower them to be ableto participate in the society productively. The city government will make a periodiccomprehensive survey on special youth which shall serve as basis for the programsand projects intended for their development.
SECTION 19. – BARANGAY LEVEL RECREATIONAL AND CULTURAL FACILITIESAND PROGRAM. A barangay-level program for the revival of indigenous games that reflectthe cultural diversity in Naga City shall be installed. The local government of Naga shallallocate space for recreation and provide recreational facilities appropriate for the youth.
ARTICLE IV – POLITICAL RIGHTS OF THE YOUTH
SECTION 20. - PARTICIPATION OF THE YOUTH IN DECISION-MAKING PROCESS.It is important to consult and provide venue for the expression of the youth’s view in city policies. Consistent to this, it is necessary that the youth sector is convened once a year, specifically during the youth month, which shall be decided by the Naga City Council for Youth Development(NCCYD) as to when shall be held, to be heard collectively of their clamors and needs.
SECTION 20-1. – YOUTH PARTICIPATION RIGHTS.
(a) Every youth has the right to congregate and form associations; as such they have the right to autonomously determine the type of organization, exercise their own initiative and act responsibly on their own so as to achieve their desired goals, provided however, that such associations are not contrary to law or public welfare.
(b) Every youth has the inherent right to take an active part in public life, and to contribute to the common good of his community and fellow citizens.
(c) Every youth has the right to initiate programs, projects, and activities that are not contrary to law or public welfare.
(d) Every youth has the right to be accorded any form of counsel, advisement, guidance, and reprimand in any undertaking fundamental to the needs and well being of his sector.
(e) Every youth has the right to commit, engage, and be involved in any form of endeavor, necessary in the full development of their sector’s interest and society as a whole.
(f) Every youth and youth association or organization has the right to seek and avail of encouragement through technical, educational, and financial support from the appropriate agencies concerned.
(g) Every youth has the right to demand for an environment that is not in conflict with the nature of employment and/or endeavor they have chosen to partake in.
(h) No youth shall be deprived of his right to participate in activities vital to his and his society’s growth and development on the basis of race, gender, creed, ideology, economic status, cultural and organizational affinity, abilities, and/or educational attainment.
SECTION 21. – The Naga City Council for Youth Development must be given delegation by the City Government in terms of planning and policy-making especially on issues involving and directly affecting the youth.
SECTION 22. – City Youth Officials Program. The Naga City Youth Officials Program shall be institutionalized, implemented, and thereafter maintained by the City Government of Nagato serve as an avenue for future leaders to be able to gain first-hand knowledge of government functions as related to community problems and development.
SECTION 22-1. – Legislative Findings. As the future leaders of country, the youth have demonstrative sincerity and enthusiasm in their effort to help build the country that they have always wanted but such involvement requires not only the sincerity and enthusiasm but a firsthand knowledge of government functions as related to community problems and development.
Said firsthand knowledge can be effectively hand by allowing intelligent, responsible, and deserving youth to take the reins of government of the City of Naga for a certain period and perform at least, the routinary functions of the government officials and/ or department heads and/or plan in actualize programs and project more specifically those affecting and requiring youth involvement.
SECTION 22-2. – Executive Committee. There is hereby created a committee which is composed of the following:
Representatives of the following sectors:
- National Youth Commission
- Metro Naga Chamber of Commerce and Industry
- Naga City People’s Council
- City Hall Press Corps
- Sanggunian Kabataan Federation
- Past Year City Youth Mayor
- Junior Chamber International (JCI)
They shall elect from among themselves a Chairman, and may create various working committees as may deemed necessary.
SECTION 22-2.A. – An Advisory Council is hereby created for this purpose, with the following composition:
Chairman: The Sectoral Youth Representative to the Sangguniang Panlungsod.
Members:
- City Administrator
- City Human Resource Mgt. Officer
- Metro Peso Manager
- City Public Information Officer
- Secretary to the Sangguniang Panlungsod
- SP Chairman on Peace & Order
- NCPC Youth Representative
- Naga City Press Corps Representative
SECTION 22-3. – Functions of the EXECUTIVE Committee.
- Five weeks before the official start of the City Youth Official Program, it shall communicate with different youth organizations existing in each barangay, schools, colleges and universities of the City of Naga about the City Youth Program.
- Cause the Dissemination of information to all radio and television station available in the locality.
- Prepare the conduct of written tests in English and General Information among the Official Youth representatives to the City Youth Officials Program and after which the conduct of an oral interview;
- Assist in the preparation for the conduct of the General Oath-taking activities of the City Youth Officials;
- Conduct general orientation meeting for the City Youth Officials on the functions/duties of their respective counterpart and the general objectives of the City Youth Officials Program.
- Issue supplementary rules and guidelines, which shall form part of this ordinance, but such rules must not contravene the provisions hereof;
- Perform such other functions which are deemed necessary for the effective implementation of this annual program.
SECTION 22-4. – QUALIFICATIONS. – Qualifications of applicants/nominees to the City Youth Officials Program are as follows:
1. He/she must be a bona fide resident of the City of naga for not less than six months prior to the submission of applications;
2. He/she must be at least a High School graduate;
3. He/she must be 15 years old but not more than 24 years old;
4. He/she must not have been a previous City Youth Official;
5. He/she must be of good moral character, as duly certified by the school head or the Punong Barangay as the case may be;
6. Can fully attend to official functions during Regular Office hours, and;
7. He/she must accomplish the Application form and submit the same together with other documentary requirements as prescribed by the Committee.
SECTION 22-5. – MANNER OF SELECTION OF CITY YOUTH OFFICIALS.
a) All qualified applicant/nominee shall convene on a date to be determined by the Committee and shall take the required written tests in English and General Information.
b) Based on the results of the written and oral (interview) examinations the youth representatives/participants who garner the top fourteen (14) highest general average shall be proclaimed by the Committee as follows:
First Placer: City Youth Mayor
Second Placer: City Youth Vice-Mayor
Third Placer: No. 1 City Youth Councilor
Fourth Placer: No. 2 City Youth Councilor
And so on up to the fourteenth (14th) placer as City Youth Councilors respectively.
The Youth Representative/participants who garner the 15th up to the 45th place shall be appointed by the City Youth mayor to the positions of City Youth Department Heads and Chiefs of Offices with the concurrence of the City Youth Sangguniang Panlungsod, to wit:
1. City Youth Administrator
2. City Youth Secretary to the Sangguniang Panlungsod
3. City Youth Planning and Development Coordinator
4. City Youth Treasurer
5. City Youth Assessor
6. City Youth Budget Officer
7. City Youth Legal Officer
8. City Youth Agriculturist
9. City Youth Veterinarian
10. City Youth Environment and Natural Resources Officer
11. City Youth Secretary to the Mayor
12. City Youth Market Superintendent
13. City Youth Population and Nutrition Officer
14. City Youth Accountant
15. City Youth Engineer
16. City Youth Metro Peso Manager
17. City Youth Social Welfare and Development Officer
18. City Youth Human Resources Management Officer
19. City Youth Civil Registrar
20. City Youth General Service Officer
21. City Youth Health Officer
22. City Youth Librarian
23. City Youth Urban Poor Affairs Officers
24. City Youth Science and Technology Centrum Administrator
25. City Youth Public Safety Officer
26. City Youth Electronics Data Processing Officer
27. City Youth Chief of Hospital
28. City Youth and NCPC Program Director
29. City Youth NCPC Chairperson
30. The rest of the slots will be designated to NCPC Sectoral Representatives.
SECTION 22-6. – Oath Taking. No representative/passer may become a City Youth Official unless he/she took an Oath of Office which shall be held on the date specified by the Executive Committee.
SECTION 22-7. – Term of Office. The City Youth Officials shall serve for one (1) year which shall commence every 15th day of April of the current year and shall expire April 14th of the following year, however, they shall serve side- by-side with their official counter parts only for the period of one and a half month, commencing from April 15 to May 31, each year.
SECTION 22-8. – Committee Quorum.The Naga City Youth Sangguniang Panlungsod Members shall be included in the determination of a quorum in various Standing Committees of the Sangguniang Panlungsod.”
SECTION 22-9. – Honorarium. The City Youth Official is entitled to receive a daily honorarium for a period of one and a half month, commencing from April 15 to May 31, each year which is equivalent to the minimum wage prevailing within the City Government of Naga, based on their actual daily accomplishment.
SECTION 22-10. – Limitation. The City Youth Officials will be given the opportunity to handle the operations of the City Government except in the areas which are policy determining of requiring monetary disbursements.
SECTION 22-11. – Funding. An annual appropriation sufficient to cover the honoraria as defined under section 22-9 hereof shall automatically be included in the City Government’s Annual Budget.
ARTICLE V
RESPONSIBILITIES OF THE YOUTH
SECTION 23. – RESPONSIBILITIES OF THE YOUTH. Every youth, regardless of the circumstances of his birth, sex, religion, social status, political antecedents and other factors shall:
(a) Strive to lead an upright and virtuous life regardless of his religious and political affiliation, the teachings of his elders and mentors, and the biddings of a clean conscience;
(b) Love, respect and obey his parents, and cooperate with them in the strengthening of the family;
(c) Extend to his brother and sisters his love, thoughtfulness, and helpfulness, and endeavor with them to keep the family harmonious and united;
(d) Exert his utmost to develop his potentialities for service, particularly by undergoing a formal education suited to his abilities, in order that he may become an asset to himself and to society;
(e) Respect not only his elders but also the customs and traditions of our people, the memory of our heroes, the duly constituted authorities, the laws of our country, and the principles and institutions of democracy;
(f) Participate actively in civic affairs and in promotion of the general welfare, always bearing in mind that it is the youth who will eventually be called upon to discharge the responsibility of leadership in shaping the nation’s future; and
(g) Help in the observance of individual human rights, the strengthening of freedom everywhere, the fostering of cooperation among nations in the pursuit of their common aspirations for programs and posterity, and the furtherance of world peace
ARTICLE VI – FINAL PROVISIONS
SECTION 24. – APPROPRIATIONS. To effectively implement this Ordinance, Youth Development Fund shall be appropriated annually where certain portions thereof shall be appropriated to cover specific programs for the youth sector.
SECTION 25. – SEPARABILITY CLAUSE. If any provision of this Ordinance is declaredinvalid or unconstitutional, the remaining provisions not affected thereby shall continue in fullforce and effect.
SECTION 26. – REPEALING CLAUSE. All ordinances, local issuances or rulesinconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.
SECTION 27. – EFFECTIVITY CLAUSE. This Ordinance shall immediately take effect upon approval.
