Ordinance No. 2005-044
AN ORDINANCE AMENDING ORDINANCE NO. 2005-031, OTHERWISEKNOWN AS THE “2005 REVISED NAGA CITY BANTAY-KATAID ORDINANCE”:-

SECTION 1. Article IV, Section 7 of Ordinance No. 2005-031 is hereby amended, now to read as follows: “SECTION 7. The objectives of BANKAT shall be:
a. To institutionalize the “Bantay-Kataid Program” or Neighborhood Crimewatch Program in the City of Naga, through the establishment of the BANKATFED that will design concrete programs in order to get the community actively involved primarily in preventing and fighting crime by encouraging all neighbors to come together and work hand in hand in exerting all efforts to deal effectively with neighborhood crime and other peace and order-related problems, as well as public safety and proper garbage disposal and segregation concerns and to cooperate in the enforcement of laws and ordinances;
b. To mandate the organization of residents into as many Bantay-Kataid (Bankat) Brigades as would be possible and necessary in every barangay in the City of Naga, to be comprised of neighbors residing in a street, block, compound, sitio or zone;
c. To establish well-organized Bankat Brigades or neighborhood crime-watch groups composed of residents in a street, block, compound, sitio or zone in a barangay that will supplement the over-all crime prevention and control program of the police organization and the barangay tanod brigades, with the end in view of creating communities whose members protect each other and serve as an efficient intelligence network to combat and suppress lawlessness in their respective areas of jurisdiction as well as actively help in promoting public safety and in proper garbage disposal and segregation from the household level;
d. To strengthen the rapport, camaraderie and unity among the officers and members of BANKAT BRIGADES and the residents in every barangay of the city;
e. To formulate, implement and coordinate programs, projects and activities beneficial to all BANKAT BRIGADES and/or general welfare of its officers and members in particular and the community in general;
f. To undertake fund-raising projects and activities to support BANKAT’s programs and objectives.”
SECTION 2. Article V, Section 8 of Ordinance No. 2005- 031 is hereby amended, now to read as follows:
“SECTION 8. DEFINITION OF TERMS. – As used in this ordinance, the terms:
a. BANTAY-KATAID PROGRAM – shall refer to the program designed to get the community actively involved primarily in crime prevention and control by encouraging neighbors to help each other and deal effectively with neighborhood crime and other peace and order-related problems as well as in the promotion of public safety and in proper garbage disposal and segregation from the household level, and to cooperate in the enforcement of laws and ordinances. It involves the organization of residents in a street, block, compound, sitio or zone in a barangay into a Neighborhood Crimewatch Unit, to be known as Bankat Brigade;
b. BANKAT BRIGADE – shall refer to the smallest unit of BANKAT, wherein residents are organized into a neighborhood crimewatch unit/group of concerned and responsible residents in a particular street, block, compound, sitio or zone of a barangay that will cooperate in the implementation of crime prevention and control as well as public safety and proper garbage disposal and segregation programs within their own neighborhood and serve as an intelligence network towards effective law enforcement and serve as a crime fighting tool of the barangay and the city government as well;
c. NAGA CITY BANKATFED – shall refer to the Bantay-Kataid Federation of Naga City comprised of all Barangay BANKAT Chapter Presidents from the 27 barangays of the city;
SECTION 3. Article VI, Section 9 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 9. COMPOSITION OF THE NAGA CITY BANKATFED. – The Federation is hereby created and shall be composed of the following:
They shall be elected from among the Barangay Chapter Presidents in a meeting called for that purpose by the Chairman of BANKATFED in coordination with the City Mayor as its Honorary Chairman. The President of the BANKATFED shall serve as the Presiding Officer of the Federation. All Chapter Presidents shall be entitled to honorarium for every regular meeting attended in such amount as may be determined by the Federation and approved by the City Mayor.
d) Executive Director of the Public Safety Office;
e) The Program Director of the Naga City People’s Council or his/her authorized representative;
f) The ABC President of Naga City or his authorized representative, as honorary member;
g) The Chief of Police or his authorized representative, as honorary member;
h) The President, Pag-Iribang Bantay Barangay Federation
of Naga City, as honorary member;
i) The Naga City Bantay-Kataid (BANKAT) Coordinator assigned at BANKAT Office and Lingkod Barangay Office.”
SECTION 4. Article VI, Section 10 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 10. FUNCTIONS OF THE NAGA CITY BANKATFED. – The Federation shall have the following functions:
a. serve as umbrella organization of all twenty seven (27) Barangay BANKAT Chapters as represented by their respective Presidents;
b. institutionalize the Bantay-Kataid Program in the City;
c. formulate guidelines for the creation of a Barangay BANKAT Chapter in every barangay in the City;
d. supervise the Barangay BANKAT Chapters in the 27 barangays in the City;
e. require the Barangay BANKAT Chapters to submit quarterly report of accomplishments;
f. establish a system of requisition and installation of street lights in case of need therefor by the BANKAT Brigades in the barangays;
g. prepare a program aimed at making the general public become a permanent partner of the local government in the suppression of
lawlessness as well as in the promotion of public safety and proper garbage disposal and segregation pursuant to Ordinance No. 2001-046 and Republic Act No. 9003;
h. establish, through the Barangay BANKAT Chapter, as many Bankat Brigades as would be possible and necessary in the barangays;
i. develop awareness among residents of each of the 27 barangays in the City that they have a basic responsibility to actively, directly
or indirectly participate in crime prevention and control as well as in the promotion of public safety and proper garbage disposal and segregation from the household level;
j. meet at least once a month, or as often as necessary, subject to the discretion of the Naga City BANKATFED Chairman;
k. undertake planning and evaluation sessions on an annual basis;
l. undertake semi-annual programming and assessments;
m. undertake systematic consultations with the barangay residents and organizations;
n. formulate and cause the implementation of short-term and long-term plans, programs and projects;
o. closely coordinate with line agencies and non-government organizations regarding the plans of action and programs approved by the Federation;
p. monitor and maintain the necessary records on the status of crime incidence in the barangays and submit an annual summary report thereof to the Sangguniang Panlungsod;
q. provide the local chief executive and the chair/s of the concerned committee/s of the Sangguniang Panlungsod, the Naga City Peace
and Order Council and the Public Safety Office with minutes, plans of action, policy recommendations or other pertinent decisions
regarding the programs and projects of the Federation, whenever necessary; and
r. perform such other functions, necessary and proper, to effect the foregoing functions.”
SECTION 5. Article VII, Section 11 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 11. CREATION OF THE BARANGAY BANKATCO. – Every barangay in the City is mandated to create the Barangay BANKATCO. The composition of the Barangay BANKATCO shall be, as follows:
c. The other six (6) Barangay Kagawads, to serve as BANKAT Coordinators of the different zones, as members;
SECTION 6. Article VII, Section 12 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 12. FUNCTIONS OF THE BARANGAY BANKATCO. – The Barangay BANKATCO shall have the following functions:
i. Institutionalize the Bantay-Kataid Program in the barangay, and provide financial support for the program, subject to availability of funds;
SECTION 7. Article VII, Section 13 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 13. CREATION OF THE BARANGAY BANKAT CHAPTER. – Every Barangay in the City is mandated to create the Barangay BANKAT Chapter pursuant to the guidelines set forth in this Ordinance. The composition of the Barangay BANKAT Chapter shall be, as follows:
a) Chapter President
b) Chapter Vice President
c) Chapter Secretary
d) Chapter Treasurer
e) Chapter Auditor
f) Chapter P.I.O.
They shall be elected from among the Brigade Leaders in the Barangay in a meeting called for that purpose by the Chairman of BANKATFED, with notice to the Barangay BANKAT Chairman, to be coordinated with the Naga City BANKATFED President. Those not elected to any of the above positions shall serve as Director/s. They shall serve for a term of two (2) years and may be elected for a period of two (2) consecutive terms for the same position, except that of a Director.”
SECTION 8. Article VII, Section 14 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 14. FUNCTIONS OF THE BARANGAY BANKAT CHAPTER. – The Barangay BANKAT Chapter shall have the following
functions:
f) Require the BANKAT Brigades to submit quarterly report of accomplishments, which shall include among others, the list of crime incidents monitored and/or resolved during the quarter and to submit on an annual basis (on or before June 30 of each year) a list of the top three (3) common crime incidents prevalent in their respective areas of jurisdiction for the past twelve (12) months;
g) Establish a system of requisition and installation of street lights in case of need therefor by the BANKAT Brigades in the barangay;
h) Monitor and maintain the necessary records on the status of crime incidence in the barangay and submit an annual summary report
thereof to the Naga City BANKAT Federation;
i) Undertake planning and evaluation sessions on an annual basis;
j) Formulate and cause the implementation of short-term and long-term plans, programs and projects;
k) Closely coordinate with the Barangay BANKATCO and the Naga City BANKATFED regarding its plans of action and programs; l) Perform such other functions, necessary and proper, to effect the foregoing functions.”
SECTION 9. Article VIII, Section 15 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 15. CREATION, QUALIFICATIONS AND COMPOSITION OF THE BARANGAY BANKAT BRIGADES. – Each
Brigade shall be composed of six (6) officers and at least five (5) but not more than ten (10) volunteers to be selected by the Barangay Council from interested residents of the sitio, street, block or zone where the Barangay BANKAT Brigade shall be established,
subject to the following qualifications:
The officers shall be elected from among themselves in a meeting called for that purpose by the BANKATFED, in coordination with the Barangay Council. The officers shall serve for a term of two (2) years, and maybe elected for a period of two (2) consecutive terms for the same position. Identification Card will be issued to each officer and member of the Brigade with two (2)-year validity, renewable every two years thereafter, should the officer/member concerned continue to remain as such.”
SECTION 10. Article VIII, Section 16 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 16. FUNCTIONS OF THE BARANGAY BANKAT BRIGADE. – Each Barangay BANKAT Brigade shall have the following functions:
i. Act as Council of Elders to attend to matters involving the promotion of peace and order and preservation and enhancement of good relations among residents and families within its area of jurisdiction; for this purpose, it shall mediate and conciliate any dispute between or among residents within its area of jurisdiction; should the same be not feasible under the circumstances, it shall refer the matter to the Barangay Chairman for appropriate action;
ii. Make an inventory of all households residing within its area of jurisdiction;
iii. Assist in the implementation of City Ordinances focusing on peace and order as well as the promotion of public safety and proper garbage disposal and segregation; for this purpose, it shall make and keep a daily record of any and all disputes, crimes or
other criminal activities taking place within its area of jurisdiction, and submit a quarterly report thereof to the Barangay BANKATCO;
iv. Coordinate with the Barangay Tanod in patrolling its area of jurisdiction;
v. Establish a system of requisition and installation of street lights in case of need therefor within its area of jurisdiction;
vi. Prepare a peace and order, public safety and cleanliness program and plan of action that suits the culture, sentiments and need of
its area of jurisdiction, aimed at making the residents become a permanent partner of the government and the authorities in the
suppression of lawlessness, and in the promotion of public safety and cleanliness of the community;
vii. Meet at least once a month, or as often as necessary, subject to the discretion of the Brigade Leader;
viii.Undertake systematic consultations with th residents and organizations within its area of jurisdiction;
ix. Assist the community in case of fire, typhoons, floods and other man-made and natural calamities;
x. Monitor and maintain the necessary records on the status of crime within its area of jurisdiction and submit a quarterly summary report thereof and of its activities to the Barangay BANKATCO and to the BANKAT Chapter; and
xi. Perform such other functions, necessary and proper, to effect the foregoing functions.”
SECTION 11. Article IX, Section 17 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“ARTICLE IX REMOVAL OF OFFICER OR DIRECTOR/VOLUNTEER FROM THE BARANGAY BANKAT CHAPTER AND BARANGAY BANKAT BRIGADE AND VACANCY THEREIN
SECTION 17. – Any officer or director of any Barangay BANKAT Chapter or any officer or volunteer of any Brigade who is found to be no longer fit to continue serving as such, upon written complaint or request signed and filed by at least a majority of the registered officers and members of the Chapter or Brigade concerned, may, after proper investigation conducted by the Naga City BANKAT Federation, be removed therefrom. The officer/director/volunteer so removed shall be notified in writing by the Naga City BANKAT Federation President. The Chapter/Brigade of the removed officer/director/volunteer shall recommend to the Naga City BANKAT Federation his/her replacement within fifteen (15) days from receipt of the notice of vacancy. Same procedure shall be followed in case the vacancy occurred due to death, resignation or disqualification of any officer or member of the Chapter or Brigade.”
SECTION 12. Article X, Section 18 of Ordinance No. 2005- 031 is hereby amended, now to read as follows:

SECTION 13. Article XII, Section 21 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 21. – Every Barangay Zone shall have a designated BANKAT Office where a signage shall be placed for identification. The Barangay BANKAT Brigade Office shall be located in any Barangay BANKAT Brigade Officer’s residence within the zone, where a signage provided by the BANKATFED shall be placed in a conspicuous place.”

SECTION 14. Article XII, Section 22 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 22. – Every Barangay BANKAT Brigade is required to identify three (3) major problems affecting the peace and order situation in its area of responsibility and shall submit copies of the same to the Barangay BANKAT Council and to the Barangay BANKAT Chapter on or before June 30 of every year. Through this, the BANKATFED can monitor the progress of BANKAT patrolling and monitoring campaign and its impact on crime incidence at the barangay level.”
SECTION 15. Article XIII, Section 23 of Ordinance No. 2005-031 is hereby amended, now to read as follows:
“SECTION 23. – The Naga City BANKATFED, all Barangay BANKAT Chapters, and all BANKAT Brigades shall adopt an official BANKAT song, to be played and sung during occasions and/or meetings. The BANKAT song shall have the following lyrics:

SECTION 16. EFFECTIVITY. – This Ordinance shall take effect immediately upon its approval.ENACTED: June 27, 2005.
