AN ORDINANCE REVISING ORDINANCE NO. 2003-020 OR THE “NAGA CITY BANTAYKATAID ORDINANCE” AND ESTABLISHING THE NAGA CITY BANTAY-KATAID FEDERATION (BANKATFED), THE BARANGAY BANTAY-KATAID COUNCILS (BANKATCO), THE BARANGAY BANKAT CHAPTERS, DEFINING THEIR COMPOSITION AND FUNCTIONS AND MANDATING THE ORGANIZATION OF BANTAY-KATAID (BANKAT) BRIGADES IN THE TWENTY SEVEN (27) BARANGAYS IN THE CITY OF NAGA:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:
ARTICLE I
TITLE AND LEGAL BASIS
SECTION 1. TITLE. – This ordinance, as revised, shall be known as the “2005
REVISED NAGA CITY BANTAY-KATAID ORDINANCE”.
SECTION 2. LEGAL BASIS OF ORDINANCE. – The legal basis for the enactment of this Ordinance is Sec. 458 (c)(ii) and (iv) in relation to Sec. 116 of the 1991 Local Government Code (RA 7160), reproduced hereunder, to wit: “Sec. 458. Powers, Duties, Functions, Compensation. – (a) The Sangguniang Panlungsod, as the legislative of the city, shall enact ordinances, approve resolutions and appropriate funds for the general welfare of the city and its inhabitants pursuant to Section 16 of this Code and in the proper
exercise of the corporate powers of the city as provided for under Section 22 of this Code, and shall:
(ii) Maintain peace and order by enacting measures to prevent and suppress lawlessness, disorder, riot, violence x x x;
(iv) Adopt measures to protect the inhabitants of the city from the harmful effects of man-made or natural disasters and calamities, and to provide relief services and assistance for victims during and in the aftermath of said disasters or calamities and in their return to productive livelihood following said events;” and
“Section 116. Organization. – There is hereby established in every province, city and municipality a local peace and order council, pursuant to Executive Order No. 309 (E.O. 309), as amended, Series of 1988. The local peace and order councils shall have the same composition and functions as those prescribed by the said executive order.”
ARTICLE II
BASIC PRINCIPLES
SECTION 3. In the realization of its objectives, BANKAT and its officers and members shall be committed to:
a) the rule of law;
b) consultative and participatory democracy;
c) public service; and
d) the “bayanihan” spirit of the Filipinos.
ARTICLE III
SYMBOL AND OFFICIAL SEAL OF BANKAT
SECTION 4. The color of the symbol and official seal of BANKAT shall be blue, red and black.
SECTION 5. The logo shall reflect three persons holding one another with a community symbolized by a silhouette of residential houses in blue in the background, with the words “BANTAY-KATAID” boldly written in black encircling from the left going to the top then to the right side, and below shall be the small number “2003”, which represents the year BANKAT was founded, and below it shall be the word “BANKAT” boldly written in red just above the words “CIUDAD NIN NAGA” also boldly written in black.
SECTION 6. The symbol and official seal of BANKAT shall be used at all times in all official meetings and assemblies, as well as in all official correspondences, shirts and kits without the need of approval of the Naga City Bantay-Kataid Federation (Naga City
BANKATFED).
ARTICLE IV
OBJECTIVES OF BANKAT
SECTION 7. The objectives of BANKAT shall be:
a. To institutionalize the “Bantay-Kataid Program” or Neighborhood Crimewatch Program in the City of Naga, through the establishment of the BANKATFED that will design concrete programs in order to get the community actively involved in preventing and fighting crime by encouraging all neighbors to come together and work hand in hand in exerting all efforts to deal effectively with neighborhood crime and other peace and order-related problems, and to cooperate in law enforcement;
b. To mandate the organization of residents into as many Bantay-Kataid (Bankat) Brigades as would be possible and necessary in every
barangay in the City of Naga, to be comprised of neighbors residing in a street, block, compound or sitio;
c. To establish well-organized Bankat Brigades or neighborhood crime watch groups composed of residents in a street, block, compound or sitio in a barangay that will supplement the over-all crime prevention and control program of the police organization and the barangay tanod brigades, with the end in view of creating communities whose members protect each other and serve as an efficient intelligence network to combat and suppress lawlessness in their respective areas of jurisdiction;
d. To strengthen the rapport, camaraderie and unity among the officers and members of BANKAT BRIGADES in every barangay of the city;
e. To formulate, implement and coordinate programs, projects and activities beneficial to all BANKAT BRIGADES and/or general welfare of its officers and members;
f. To undertake fund raising projects and activities to support BANKAT’s program and objectives.
ARTICLE V
DEFINITION OF TERMS
SECTION 8. DEFINITION OF TERMS. – As used in this ordinance, the terms:
a. BANTAY-KATAID PROGRAM – shall refer to the program designed to get the community actively involved in crime prevention and control by encouraging neighbors to help each other and deal effectively with neighborhood crime and other peace and order-related problems, and to cooperate in law enforcement. It involves the organization of residents in a street, block, compound or sitio in a barangay into a Neighborhood Crimewatch Unit, to be known as Bankat Brigade;
b. BANKAT BRIGADE – shall refer to an organized neighborhood crimewatch unit/group of concerned and responsible residents in a particular street, block, compound or sitio of a barangay that will cooperate in the implementation of crime prevention and control programs within their own neighborhood and serve as an intelligence network towards effective law enforcement and serve as a crime fighting tool of the barangay and the city government as well;
c. NAGA CITY BANKATFED – shall refer to the Bantay-Kataid Federation of Naga City;
d. BARANGAY BANKATCO – shall refer to the BANKAT COUNCIL established in every Barangay, pursuant to Section 11, Article VII of this Ordinance;
e. BARANGAY BANKAT CHAPTER – shall refer to the Bantay-Kataid Chapter established in every Barangay, pursuant to Section 13, Article VII of this Ordinance.
ARTICLE VI
CREATION, COMPOSITION AND FUNCTIONS OF THE NAGA CITY BANTAY-KATAID FEDERATION (BANKATFED)
SECTION 9. COMPOSITION OF THE NAGA CITY BANKATFED. – The Federation is hereby created and shall be composed of the following:
a) The City Mayor, as Honorary Chairman;
b) The Sangguniang Panlungsod Chairman of the Committee on Public Safety, Human Rights and Peace and Order, as Chairman and Chief Executive;
c) Twenty seven (27) Officers and Board of Directors of BANKATFED, as follows;
a. President
b. Vice President
c. Secretary
d. Treasurer
e. Auditor
f. P.I.O.
g. Twenty one (21) Board of Directors They shall be elected from among the Barangay Chapter Presidents in a meeting called for that purpose by the Chairman of BANKATFED in coordination with the City Mayor as its Honorary Chairman. The President of the BANKATFED shall serve as the Presiding Officer of the Federation. All Chapter Presidents shall be entitled to traveling allowance for every regular meeting attended in such amount as may be determined by the Federation and approved by the City Mayor. They shall serve for a term of two (2) years, without prejudice to re-election for another term.
d) The ABC President of Naga City or his authorized representative, as honorary member;
e) The Chief of Police or his authorized representative, as honorary member;
f) The President, Pag-Iribang Bantay Barangay Federation of Naga City, as honorary member;
g) The Naga City Bantay-Kataid (BANKAT) Coordinator assigned at BANKAT Office and Lingkod Barangay Office.
SECTION 10. FUNCTIONS OF THE NAGA CITY BANKATFED. – The Federation shall have the following functions:
a. serve as umbrella organization of all twenty seven (27) Barangay BANKAT Chapter Presidents;
b. institutionalize the Bantay-Kataid Program in the City;
c. formulate guidelines for the creation of a Barangay BANKAT Chapter in every barangay in the City;
d. supervise the Barangay BANKAT Chapters in the 27 barangays in the City;
e. require the Barangay BANKAT Chapters to submit quarterly report of accomplishments;
f. establish a system of requisition and installation of street lights in case of need therefor by the BANKAT Brigades in the barangays;
g. prepare a program aimed at making the general public become a permanent partner of the local government in the suppression of lawlessness;
h. establish, through the Barangay BANKAT Chapter, as many Bankat Brigades as would be possible and necessary in the barangays;
i. develop awareness among residents of each of the 27 barangays in the City that they have a basic responsibility to actively, directly or indirectly participate in crime prevention and control;
j. meet at least once a month, or as often as necessary, subject to the discretion of the Naga City BANKATFED Chairman;
k. undertake planning and evaluation sessions on an annual basis;
l. undertake semi-annual programming and assessments;
m. undertake systematic consultations with the barangay residents and organizations;
n. formulate and cause the implementation of short-term and long-term plans, programs and projects;
o. closely coordinate with line agencies and non-government organizations regarding the plans of action and programs approved by the Federation;
p. monitor and maintain the necessary records on the status of crime incidence in the barangays and submit an annual summary report thereof to the Sangguniang Panlungsod;
q. provide the local chief executive and the chair/s of the concerned committee/s of the Sangguniang Panlungsod with minutes, plans of action, policy recommendations and other pertinent decisions regarding the programs and projects of the Council; and
r. perform such other functions, necessary and proper, to effect the foregoing functions.
ARTICLE VII
CREATION, COMPOSITION, AND FUNCTIONS OF THE BARANGAY BANTAY-KATAID COUNCIL (BANKATCO) AND BARANGAY BANKAT CHAPTER
SECTION 11. CREATION OF THE BARANGAY BANKATCO. – Every barangay in the City is mandated to create the Barangay BANKATCO. The composition of the Barangay BANKATCO shall be, as follows:
a. The Barangay Captain, as Chairman;
b. The Sangguniang Barangay Chairman of the Committee on Peace and Order/Public Safety, as Vice Chairman; and shall serve as BANKAT Coordinator of one (1) zone in the Barangay;
c. The other six (6) Barangay Kagawads, to serve as BANKAT Coordinator of the different zones, as members;
d. The BANKAT Brigade Leaders, as members;
e. The Barangay Chief Tanod, as member.
SECTION 12. FUNCTIONS OF THE BARANGAY BANKATCO. – The Barangay
BANKATCO shall have the following functions:
i. Institutionalize the Bantay-Kataid Program in the barangay;
ii. Establish as many Bankat Brigades as would be possible and necessary
in the barangay;
iii. Meet at least once a month, or as often as necessary, subject to the discretion of the Barangay BANKATCO Chairman;
vii. Undertake planning and evaluation sessions on an annual basis;
v. Perform such other functions, necessary and proper, to effect the foregoing functions.
SECTION 13. CREATION OF THE BARANGAY BANKAT CHAPTER. – Every
Barangay in the City is mandated to create the Barangay BANKAT Chapter pursuant to the guidelines set forth in this Ordinance. The composition of the Barangay BANKAT Chapter shall be, as follows:
a) Chapter President
b) Chapter Vice President
c) Chapter Secretary
d) Chapter Treasurer
e) Chapter Auditor
f) Chapter P.I.O.
They shall be elected from among the Brigade Leaders in the Barangay in a meeting called for that purpose by the Chairman of BANKATFED, with notice to the Barangay BANKAT Chairman, to be coordinated with the Naga City BANKATFED President.
SECTION 14. FUNCTIONS OF THE BARANGAY BANKAT CHAPTER. – The Barangay BANKAT Chapter shall have the following functions:
a) Serve as the umbrella organization of all BANKAT Brigades in the Barangay;
b) Coordinate with the Naga City BANKAT Federation;
c) Monitor the operation of all BANKAT Brigades in the barangay;
d) Meet at least once a month, or as often as necessary, subject to the discretion of the Chapter President;
e) Supervise the BANKAT Brigades in the barangay;
f) Require the BANKAT Brigades to submit quarterly report of accomplishments, which shall include among others, the list of crime incidents monitored and/or resolved during the quarter and the three (3) most common crime incidents that occurred during the same period;
g) Establish a system of requisition and installation of street lights in case of need therefore by the BANKAT Brigades in the barangay;
h) Monitor and maintain the necessary records on the status of crime incidence in the barangay and submit an annual summary report thereof to the Naga City BANKAT Federation;
i) Perform such other functions, necessary and proper, to effect the foregoing functions.
ARTICLE VIII
CREATION, COMPOSITION AND FUNCTIONS OF THE BARANGAY BANTAY-KATAID (BANKAT) BRIGADES
SECTION 15. CREATION, QUALIFICATIONS AND COMPOSITION OF THE
BARANGAY BANKAT BRIGADES. – Each Brigade shall be composed of six (6) officers and at least five (5) but not more than ten (10) volunteers to be selected by the Barangay Council from interested residents of the sitio, street, block or zone where the Barangay BANKAT Brigade shall be established, subject to the following qualifications:
i. Resident of the Barangay for at least six (6) months preceding the appointment;
ii. At least twenty one (21) years old;
iii. Physically, mentally and emotionally fit;
iv. Good moral character;
v. Should not be receiving regular, fixed compensation from the Barangay;
The composition of the Barangay BANKAT Brigade shall be, as follows:
a. Brigade Leader
b. Brigade Assistant Leader
c. BANKAT Secretary
d. BANKAT Treasurer
e. BANKAT Auditor
f. BANKAT Public Information Officer (P.I.O.)
g. Between five (5) to ten (10) Brigade Volunteers The officers shall be elected from among themselves in a meeting called for that purpose by the BANKATFED, in coordination with the Barangay Council. Identification Card will be issued to each officer and member of the BANKATFED and the Barangay BANKAT Chapters, with one (1) year validity, renewable every year thereafter, should the officer/member concerned continue to remain as such.
SECTION 16. FUNCTIONS OF THE BARANGAY BANKAT BRIGADE. – Each Barangay BANKAT Brigade shall have the following functions:
i. Act as Council of Elders to attend to matters involving the promotion of peace and order and preservation and enhancement of good relations among residents and families within their area of jurisdiction;
ii. Mediate and conciliate any dispute between or among residents within their area of jurisdiction; should the same be not feasible under the circumstances, they shall refer the matter to the Barangay Lupon for appropriate action;
iii. Make an inventory of all households residing within their area of jurisdiction;
iv. Make and keep a daily record of any and all disputes, crimes or other criminal activities taking place within their area of jurisdiction, and submit a monthly report thereof to the Barangay BANKATCO;
v. Assist in the implementation of City Ordinances;
vi. Coordinate with the Barangay Tanod in patrolling their area of jurisdiction;
vii. Establish a system of requisition and installation of street lights in case of need therefore thin their area of jurisdiction;
viii. Prepare a peace and order program and plan of action that suits the culture,sentiments and need of their area of jurisdiction, aimed at making the residents become a permanent partner of the government and the authorities in the suppression of lawlessness;
ix. Develop awareness among residents within their area of jurisdiction that they have a basic responsibility to actively, directly or indirectly participate in crime prevention and control;
x. Meet at least once a month, or as often as necessary, subject to the discretion of the BANKAT Chapter President;
xi. Undertake planning and evaluation sessions on an annual basis;
xii. Undertake semi-annual programming and assessments;
xiii. Undertake systematic consultations with the residents and organizations within their area of jurisdiction;
xiv. Formulate and cause the implementation of short-term and long-term plans, programs and projects;
xv. Closely coordinate with the Barangay BANKATCO and the Naga City BANKAT Federation regarding their plans of action and programs;
xvi. Monitor and maintain the necessary records on the status of crime within their area of jurisdiction and submit a quarterly summary report thereof and of their activities to the Barangay BANKATCO and to the Naga City BANKAT Federation; and
xvii. Perform such other functions, necessary and proper, to effect the foregoing functions.
ARTICLE IX
REMOVAL OF OFFICER OR MEMBER FROM THE BARANGAY BANKAT CHAPTER AND BARANGAY BANKAT BRIGADE
SECTION 17. – Any officer or member of any Barangay BANKAT Chapter or Brigade who is found to be no longer fit to continue serving as such, upon written complaint or request signed and filed by at least a majority of the registered officers and members of the Chapter or Brigade concerned, may, after proper investigation conducted by the Naga City BANKAT Federation, be removed therefrom. The officer/member so removed shall be notified in writing by the Naga City BANKAT Federation President. The Chapter/Brigade of the removed officer/member shall recommend to the Naga City BANKAT Federation his/her replacement within fifteen (15) days from receipt of the notice of vacancy. Same procedure shall be followed in case the vacancy occurred due to death, resignation or disqualification of any officer or member of the Chapter or Brigade.

AFFECTING PEACE AND ORDER SITUATION
SECTION 20. – The twenty seven (27) Barangay BANKAT Chapters shall be divided into seven (7) groupings or clusters, for purposes of patrolling schedule. The schedule of simultaneous monitoring/patrolling by the chapters according to clusters shall be coordinated with their respective Barangay Chief Tanods, and implemented in the twenty seven (27) barangays pursuant to the following groupings and schedule:

The synchronized barangay group monitoring campaign as well as the patrolling according to groupings shall start between 9 p.m. and midnight of the scheduled day, but the time may be made earlier than 9:00 p.m. or extended beyond 12:00 midnight, at the discretion of the BANKAT Chapter or as the need arises.
SECTION 21. – Every Barangay BANKAT Brigade shall have a designated BANKAT Office where a signage shall be placed for identification. The Barangay BANKAT Brigade Office shall be located in any Barangay BANKAT Brigade Officer’s residence, where a signage provided by the BANKATFED shall be placed in a conspicuous place.
SECTION 22. – Every Barangay BANKAT Brigade is required to identify three (3) major problems affecting the peace and order situation in its area of responsibility and shall submit copies of the same to the Barangay BANKAT Council and to the Naga City BANKAT Federation. Submission should be done quarterly, so that the BANKATFED can monitor the progress of BANKAT patrolling and monitoring campaign and its impact on crime incidence at the barangay level.
ARTICLE XIII
BANKAT HYMN & CREED
SECTION 23. – The Naga City BANKATFED, all Barangay BANKAT Chapters, and all BANKAT Brigades shall adopt an official BANKAT hymn, to be played and sung during occasions and/or meetings. The BANKAT hymn shall have the following lyrics:

ARTICLE XIV
TRANSITORY PROVISION SECTION 24. TRANSITORY PROVISION. – Within two (2) weeks from effectivity of this Ordinance, the existing BANKAT Units (now renamed as BANKAT Brigades) shall be convened by the Barangay Captain of each Barangay for the purpose of verifying from the Barangay Unit Presidents (now BANKAT Brigade Leaders) who among the existing officers and members of each Unit (Brigade) are still active and interested to remain and are still qualified to be retained as officer/member of the Unit (Brigade) pursuant to Section 15, Article VIII of this Ordinance. Should the BANKAT Units (Brigades) so decide, upon prior consultation among theirexisting officers and members, each Unit (Brigade) shall hold an election, if no election has yet been held, to be supervised by the BANKAT Federation President within three (3) weeks from effectivity of this Ordinance. Each Barangay BANKATCO shall be required to submit the official list of all BANKAT Units (Brigades) in the Barangay within four (4) weeks from effectivity of this Ordinance.
ARTICLE XV
FUNDING REQUIREMENT AND EFFECTIVITY OF THE ORDINANCE
SECTION 25. FUNDING REQUIREMENT AND BENEFIT – The funding for the operation of Bantay-Kataid (BANKAT) program shall be taken from or charged against the existing appropriation for Local Development Fund as may be approved by the City Mayor. BANKAT Chapter Officers and Members shall be given such insurance coverage or health care benefit as may be recommended by the BANKATFED and approved by the City Mayor.
SECTION 26. SEPARABILITY CLAUSE – Any provision or portion of this ordinance found to be violative of the constitution or invalid shall not impair the other provisions or parts thereof which shall continue to be in force and in effect.
SECTION 27. REPEALING CLAUSE – Ordinances, rules and regulations or parts thereof, which are inconsistent or in conflict with the provisions of this ordinance, are hereby repealed or modified accordingly.
SECTION 28. EFFECTIVITY – This ordinance shall take effect immediately upon its approval and publication in a newspaper of general circulation.
