AN ORDINANCE AMENDING ORDINANCE NO. 2003-020 BY DESIGNATING THE CITY MAYOR OF NAGA AS CHAIR OF THE BANTAY KATAID PROGRAM AND THE CHAIRMAN OF SANGGUNIANG PANLUNGSOD COMMITTEE ON PUBLIC SAFETY AS CO-CHAIR:-

WHEREAS, Ordinance No. 2003-020 establishes the Bantay Kataid Program or Neighbourhood Crimewatch Program in the City of Naga, through the establishment of a Council that will design concrete programs in order to get the community actively involved in preventing and fighting crime by encouraging all neighbours to come together and work hand in hand in exerting all efforts to deal effectively with neighbourhood crime and other  peace and order-related problems, and to cooperate in law enforcement;

WHEREAS, as provided in Ordinance No. 2003-020, it is the chairman of the SP Committee on Public Safety who heads and presides over the Bantay Kataid Council of Naga City;

WHEREAS, the City Mayor only sits as honorary chairman of the Bantay-Kataid Council of Naga City, meaning that if he is around during any meeting of the said organization he is recognized as the presiding officer and head of the same;

WHEREAS, the main function of a councilor or a member of the Sangguniang Panlungsod of Naga is to legislate and, due to the principle of shared governance, to assist the city mayor in implementing the administration’s programs;

WHEREAS, the city mayor, being the local chief executive of the city, has the primary responsibility and obligation to implement city programs and, along with it, maintain the peace and order of the locality;

NOW, THEREFORE, on motion of Hon. Elmer S. Baldemoro, seconded by Hon. Mila S.D. Raquid-Arroyo;

BE IT ORDAINED, therefore, by the 11th Sangguniang Panlungsod of Naga to:

SECTION 1. Section 5 of Ordinance No. 2003-020 is hereby amended to now read as follows:

“SECTION 5. COMPOSITION OF THE NAGA CITY BANKATCO. – The Council shall be composed of the following:

a)  The City Mayor; as Chairman and Chief Executive   and Presiding Officer;

b) The Sanggunaing Panlungsod Chairman of the  Committee on Public Safety, as Co-Chairman;

c)  The ABC President of Naga City or his authorized representative, as member;

d) The Sangguniang Kabataan Federation of Naga City or his authorized representative, as member;

e)  The City Director of the Department of Interior and Local Government or his authorized representative, as member;

f) The Chief of Police or his authorized representative, as member;

g) The Chief of the NAPOLCOM Camarines Sur Provincial Office or his representative, as member;

h)  The Head of the Lingkod Barangay Office of Naga City or his authorized representative, as member;

i) The Head of the General Services Department of the Naga City Government or his authorized representative, as member;

j) Representative from the Naga City People’s Council (NCPC), as member;

k) The President, Pag-Iribang Bantay Barangay Federation of Naga City or his authorized representative, as member;

l) The President, Kapisanan ng mga Brodkaster sa Pilipinas (KBP) Camarines Sur Chapter or his authorized representative, as member; and

m) The President, Senior Citizens Federation President of Naga City or his authorized representative, as member.”

SECTION 2. All ordinances, executive issuances and rules and regulations inconsistent with the provisions of this ordinance are hereby repealed, amended or modified accordingly.

Ordinance No. 2015-006

ORDINANCE DIRECTING FOR AN IMMEDIATE FARE REDUCTION IN THE TRIMOBILES IN THE CITY OF NAGA, AND ESTABLISHING PROVISIONAL RATES FOR THE PURPOSE:-

SHORT EXPLANATORY NOTE

There has been series of roll back since the last quarter of 2014 in the cost of fuel being used by private and public utility vehicles.  But the fare in the city’s trimobiles remains at a standstill, at a price when the cost of fuel was at an all time high.  Downward cost of fuel must have corresponding effect on the fare, as during upward trend.

The City Government needs to protect the riding public by effecting an immediate fare reduction in the trimobiles, which is under the regulatory powers of the City Government.  Thus, this proposed ordinance.

NOW, THEREFORE, on motion of Hon. D.C. Nathan A. Sergio, seconded by Hon. Gabriel H. Bordado Jr. and Hon. Jose A. Tuason, be it ordained, as it is hereby ordained, that:

SECTION 1. DIRECTIVE. There shall be an immediate fare reduction in the trimobiles in the City of Naga.

SECTION 2. PROVISIONAL RATES. This new provisional fare rate for trimobiles in Naga City shall be P7.50 per passenger.  A discounted fare rate of P6.00 shall be accorded to every student, Senior Citizen and Person with Disability (PWD).

For purposes of availment of the benefit for Senior Citizen and Person with Disability (PWD), the driver is enjoined to take notice of their physical appearance and when they determine that such is not necessary, the Identification Card shall not be required.

Should the cost of fuel further drops to P32.00 per liter, there shall be an automatic fare reduction in trimobiles to P7.00 per passenger, or a discounted fare of P5.50 for every Student, Senior Citizen and Person with Disability with valid Identification Card.

SECTION 3. AUTOMATIC FARE ADJUSTMENT. An automatic upward adjustment of fare rate may be effected should there the cost of fuel exceeds P37.00 per liter, without need of request to return to the P8.00 per passenger regular rate if the fuel prices goes back to its level prior to fuel price decrease.

SECTION 4. INFORMATION AND ENFORCEMENT. The Public Safety Office and the Task Force Trimobile, in so far as trimobiles are concerned, shall jointly undertake measures for the quick information dissemination of the new or provisional rates of Trimobiles.  In addition, the city’s CEPPIO shall relay the information to the tri-media for the widest public information purposes.

Law enforcers, particularly those manning the streets and vehicular traffic, shall ensure compliance to this Ordinance particularly by all the trimobile drivers and operators.

SECTION 5. EFFECTIVITY. This Ordinance shall take effect immediately upon approval.

AN ORDINANCE EXTENDING THE DUE DATE OF THE 1ST QUARTER PAYMENT OF TAXES, FEES AND CHARGES FROM JANUARY 20 TO JANUARY 23, 2015 WITHOUT IMPOSING THE CORRESPONDING SURCHARGE AND INTEREST THEREON:-

On joint and collective motion

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 1. – The due date of the 1st Quarter payment of taxes, fees and charges is hereby extended from January 20 to January 23, 2015 without imposing the corresponding surcharge and interest thereon;

SECTION 2. – This ordinance shall take effect upon its approval.
