AN ORDINANCE AMENDING SECTION 7 OF ORDINANCE NO. 2014-085, ENTITLED: “ AN ORDINANCE CONSOLIDATING THE SENIOR CITIZENS ORDINANCES NOS. 1992-042, 1992-049, 2002-017, 2006-70, 2010-066, 2011-018, 2013-036, 2013-054, AND 2014-034, RESOLUTION NO. 2010-340 AND INTEGRATING THEREIN THE SENIOR CITIZENS MONTH EXECUTIVE ORDER 2006-016, AMENDING SOME SECTIONS IN THE PROCESS”:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 1. – Section 7 of Ordinance No. 2014-085, entitled: “ An ordinance consolidating the Senior Citizens Ordinances Nos. 1992-042, 1992-049, 2002-017, 2006-70, 2010-066, 2011-018, 2013-036, 2013-054, and 2014-034, Resolution No. 2010-340 and integrating therein the Senior Citizens Month Executive Order 2006-016, amending some sections in the process”, is hereby amended, now to read as follows:

SECTION 7. Senior Citizens Month. October is declared as Senior Citizens Month and the City Senior Citizen Officials Program (CSCOP) is adopted, provided however, that the implementation of the City Senior Citizen Officials Program for the year 2015 will be in the month of November.”

SECTION 2. – This ordinance shall take effect upon its approval.

Ordinance No. 2015-064

AN ORDINANCE HIGHLIGHTING THE PUBLIC NATURE OF THE RAUL S. ROCO LIBRARY AND MANDATING THE FORMULATION AND IMPLEMENTATION OF A LONG-TERM PUBLIC LIBRARY DEVELOPMENT PROGRAM:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga that:

SECTION 1.   Title – This ordinance shall be known as the Raul S. Roco-Naga City Public Library Development Ordinance.

SECTION 2.  Declaration of Purpose and Policy – The City of Naga subscribes to Republic Act No. 7743, the Act Providing for the Establishment of Congressional, City and Municipal Libraries and Barangay Reading Centers Throughout the Philippines . . ., to the Public Library Manifesto of the International Federation of Library Associations and the United Nations Educational, Scientific, and Cultural Organization (IFLA-UNESCO), and to the Standards for Philippine Libraries: Public Libraries of the Board of Librarians–Professional Regulation Commission.

Thus, the general purposes of the public library of the City of Naga are:

a. To provide  library and information service to the needs of the community;
b. To build within the library an information center about Bicol and the City of Naga—their histories, resources, people, customs and traditions, etc.;
c. To establish linkages with other libraries to facilitate reference needs of its patrons

SECTION 3.  Name -  The local library established as the provincial public library in 1921, reestablished as the city public library in 1957, renamed as the Raul S. Roco Library in 2005, in honor of that erudite, great Bicolano leader, shall henceforth be known as the Raul S. Roco-Naga City Public Library, Raul Roco-Naga Public Library for short (RNPL).

SECTION 4.  Standardization – The RNPL shall by the end of 2017 meet at least the minimum requirements based on the Standards for Public Libraries prescribed by the Philippine Board of Librarians, and by the end 2019 shall rate satisfactory in all the aspects of library operations, namely:

a. Mission, Goals and Objectives
b. Administration
c. Human Resources
d. Collection Development
e. Services and Utilization
f.  Physical Facilities
g. Information and Facilities Services
h. Financial Resources
i. Linkages and Networking

SECTION 5. Standardization Committee – The RNPL Standardization Committee is hereby constituted to evaluate the status of the RNPL annually, the first being no later than May 2016.  It shall be composed of:

a. Chair of the Sangguniang Panlungsod Committee on Education, Chairman
b. RNPL Librarian, Secretary
c. Representative of the Department of Education Division Office, Member
d. Practicing Librarian of a Public School, Member
e. Practicing Librarian of a Private School, Member

The RNPL Standardization Committee shall adapt the Standards for Public Libraries for its evaluation instrument or any such veritable instrument as may be available.  It shall submit its first Evaluation Report to the City Mayor and the Sangguniang Panlungsod no later than 30 June 2016, and every June 30 thereafter.  The 2016 and later reports shall contain Analysis, Evaluation, and Recommendation.  2017 thenceforth the reports shall add the section  Action Taken on Previous Recommendations.

SECTION 6. Raul Roco-Naga Public Library Board – Pursuant to the Implementing Rules and Regulation of RA 7743, the Raul Roco-Naga Public Library Board is hereby constituted. It shall be composed of:

a. City Mayor, Chairman
b. Chairman of the Sangguniang Panlungsod Committee on Education,
Vice-Chairman
c. City Treasurer, Member
d. City Budget Officer, Member
e. Sangguniang Kabataan Federation President, or in the absence of one, the City Youth Mayor, Member
f. President of the Friends of the RNPL, or in the absence of one, the Naga City People’s Council (NCPC) Representative, Member
g. Librarian, Secretary

The RNPL Board shall be the policy-making body of the public library.  It shall have the following functions:

aa.  To formulate and regularly update the RNPL Development Plan

bb. To formulate all library policies, rules and procedures

cc.  To determine the annual budgetary needs for the operation and maintenance of the RNPL

dd. To find ways and means in increasing the book and non-book collection and in improving the facilities and services

ee.  To serve as advisory body to the Sangguniang Panlungsod on public library matters

SECTION 7.  Appropriations -  The Local Expenditure Program shall provide for the maintenance and continued improvement of the RNPL according to the regularly updated long-term development plan.

SECTION 8.  Repealing Clause – Upon effectivity of this ordinance all related ordinances are hereby repealed.

SECTION 9. Separabilty Clause – Should any portion or provision of this ordinance be declared unconstitutional or invalid, the other parts thereof which are not affected thereby and shall continue to be in full force and effect.

SECTION 10. Effectivity – This ordinance shall be effective upon approval.

AN ORDINANCE REVISING ORDINANCE NO. 2015-052 entitled “ORDINANCE EXERCISING THE POWER OF EMINENT DOMAIN OVER THE PARCEL OF LAND DESCRIBED AS LOT 1-B-2-C-2-A, PSD-05-010441, BEING A PORTION OF LOT 1-B-2-C-2, PSD-05-009264 WITH TCT NUMBER 19965 WITH AN AREA OF ONE HUNDRED TWENTY SEVEN (127) SQUARE METERS, LOCATED AT BARANGAY CONCEPCION GRANDE, NAGA CITY, REGISTERED IN THE NAME OF MERCEDES N. ABELLA, ET AL NOW OWNED BY LYNN S. STAGGS AND AUTHORIZING THE CITY MAYOR TO FILE THE INITIATORY COMPLAINT OR PLEADING IN COURT, AND FURTHER  APPROPRIATING THE AMOUNT OF ONE HUNDRED ONE THOUSAND SIX HUNDRED (P 101,600.00) PESOS TO COVER THE PAYMENT FOR JUST COMPENSATION” BY ADDING CERTAIN PROVISIONS THAT WILL SPELL OUT COMPLIANCE WITH THE REQUIREMENTS THEREFOR:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 1. – Necessity and Purpose of Expropriation. – The subject property has long been used as a road used by the general public particularly by residents of Zone 1, Concepcion Grande Dry Creek Urban Poor community, and by the beneficiaries of the Urban Poor Relocation Site in Barangay Balatas.  In order to provide unimpeded use by the public over this subject property to protect their welfare, there is a need for the City Government to exercise its power of eminent domain thereon;

SECTION 2. Compliance with Procedural Requirements. On March 10, 2015, the Sangguniang Panlungsod of Naga passed Resolution No. 2015-072 authorizing the City Mayor to negotiate for the acquisition of the subject property. Pursuant to the said Resolution, the City Mayor sent a letter offer to the landowner dated 19 March 2015 for the purchase thereof.  Upon personal service of the said letter-offer, the Authorized Representative of the landowner, Mrs. Zenaida Salvador, openly expressed her opposition and rejection of the offer.  Based on the said response of the landowner’s authorized representative, the Sangguniang Panlungsod of Naga passed  Ordinance  No.  2015-013  expropriating  the subject property.  Upon information that another representative of the landowner requested until April 18, 2015 within which to submit their final response, the Sangguniang Panlungsod revoked Ordinance No. 2015-013 by re-passing another expropriation ordinance, Ordinance No. 2015-052 in view of the failure of negotiation as evidenced by the landowner’s failure to give its reply to the City’s offer within the period requested by her despite several months having already passed. In the City’s desire to spell out concretely its compliance with the requirements for expropriation, the Sangguniang Panlungsod hereby revises Ordinance No. 2015-052.

SECTION 3. Exercise of the Power of Eminent Domain. In view of the apparent refusal  of the landowner to accept the offer of the City Government to buy the subject property in order that the same may be utilized as a public road,  the City Government of Naga hereby exercises its power of eminent domain over the parcel of land being described as lot 1-b-2-c-2-a, Psd-05-010441, being a portion of lot 1-b-2-c-2, Psd-05-009264 with TCT number 19965 with an area of one hundred twenty seven (127) square meters, located at Barangay Concepcion Grande, Naga City, registered in the name of Mercedes N. Abella, et al now owned by Lynn S. Staggs;

SECTION 4. Authority. The City Mayor is hereby authorized to sign and file the initiatory complaint/pleading in the proper court and to represent the city in all the stages of the proceedings thereon, to make stipulations and/or admissions of facts in the pre-trial, to enter into a compromise or amicable settlement, to submit to alternative modes of dispute resolution, and to perform such acts and things as may be necessary to carry out the foregoing authority.

In view of the urgency of the matter considering the situation of the immediately affected residents that poses danger to their safety and well-being due to lack of access road, this authority shall be acted upon with dispatch.

In case of a settlement or compromise agreement, the same shall be subject to the ratification of the Sangguniang Panlungsod.

SECTION 5.- Appropriation. The amount of One Hundred One Thousand Six Hundred (P101,600.00) Pesos is hereby appropriated to cover the payment for just compensation, chargeable against the 2014 Surplus;

SECTION 6. Effectivity. This ordinance shall take effect immediately upon its approval.
