AN ORDINANCE GOVERNING THE GENERAL TERMS OF REFERENCE FOR THE DEVELOPMENT AND UTILIZATION OF CERTAIN PORTIONS OF THE BICOL CENTRAL STATION COMPLEX:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 1. Objectives and description of the property for lease:

The objectives of the lease are:

a) To encourage the participation of the private sector in local governance especially in the delivery of basic services and operation and management of economic enterprises;

b) To generate more income for the city through rental of the city owned property; and

c) To keep a paradigm for economic growth in stimulating development surrounding the area.

SECTION 2.    Declaration of Use. Certain portions of the Bicol Central Station Complex, as hereunder described, are hereby declared open for development and utilization by the private sector for commercial purposes under a lease agreement with the City Government of Naga.

SECTION 3. Areas Covered. The portions of the BCS complex covered under this ordinance are the following:

a.) Second Floor of the BCS Complex facing SM City Naga with an area of more or less 2,291 sq. m.;

b.) Vacant lot beside Sogo Hotel with an area of more or less 2,395 sq. m.; and

c.) Second Floor facing the CBD Hotel with an area of more or less 1,120 sq. m.

SECTION 4.    Award of Lease Contract. The development, operation and management of the portions of the BCS Complex subject of this Ordinance shall be awarded through a competitive bidding. For this purpose, the Naga City BAC shall promulgate the term of reference, and subject to the ratification by the Sangguniang Panlungsod.

SECTION 5. Minimum requirements. The Term of Reference that the Naga City BAC shall promulgate shall be guided, among others, by the following:

1.  Monthly Rental Rate :     Not less than P 50.00/sq. m./mo. This rate shall be reviewed every 3 years taking into consideration the existing economic situation in the City of Naga;

2.  Security Deposit :     3 mos. Rent, payable upon signing the contract of lease.

3.  Advance Rental :     3 mos. Rent, payable upon turn-over of possession and control over the leased premises.

4. Duration of Lease
Contract and rental
escalation rate : Shall take into consideration, reasonable period for return on investment.

SECTION 6. Contractual Arrangements:

6.1 The City Government of Naga shall act through its City Mayor, who is duly authorized by the Sanggunian, to enter into a Contract of Lease with the lessee such contract of lease shall be ratified by the Sangguniang Panlungsod;

6.2 The Lease Contract shall be signed by the lessee duly authorized for the purpose;

6.3 If the areas subject of this ordinance will be sub-leased by the lessee, the City Government reserve the right to review the rental rate that the lessee will set within the purview of reasonable return on investment; and

6.4 All improvement that the lessee shall introduce under this ordinance shall be fully turned over to the City Government of Naga upon the expiration of the lease agreement.

SECTION 8. EFFECTIVITY. This ordinance shall take effect upon its approval.

Ordinance 2014-026

AN ORDINANCE AMENDING ORDINANCE NO. 2013-062, ENTITLED: “AN ORDINANCE SETTING THE GUIDELINES FOR THE INTERIM OPERATION OF THE CENTRAL BUS TERMINAL COMPLEX BY THE CITY GOVERNMENT OF NAGA AND THE PUBLIC BIDDING FOR ITS MANAGEMENT THEREAFTER” BY SUSPENDING THE PERIOD INDICATED UNDER SECTION 19 THEREOF:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 1. –Ordinance No. 2013-062, entitled: “An ordinance setting the guidelines for the interim operation of the Central Bus Terminal Complex by the City Government of Naga and the public bidding for its management thereafter”, is hereby amended by suspending the period indicated in the hereunder quoted Section 19 thereof:

SECTION 19.Bidding.An invitation to bid soliciting tenders for the improvement, operation and management of the Naga City Central Bus Terminal shall be published in at least two national newspapers of general circulation not later than April 30, 2014. The bidding process shall be concluded and an award made not later than August 31, 2014;”

SECTION 2. This ordinance shall take effect upon its approval.

Ordinance No. 2014-025

AN ORDINANCE PRESCRIBING BASIC ADMISSION REQUIREMENTS AND THE TUITION AND OTHER  FEES AT SEED MONTESSORI I AND SEED MONTESSORI II BEGINNING SCHOOL YEAR 2014-2015:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga that:

SECTION 1.  Basic Admission Requirements. To be admitted to either SEED Montessori I or SEED Montessori II :

1.  The child should be aged 3 to 3.5 years old for Nursery I; 3.6 to 4.5 years old for Nursery II;

2.  The child should undergo both the oral and written diagnostic assessments;

3.  The child’s parents should be registered voters of Naga City;

4.  The child’s parents should express agreement with the conditions for admission.

SECTION 2.  Priority for Children of Naga City Hall Employees. Priority for admission to either SEED Montessori I or SEED Montessori II shall be given to children of Naga City Hall employees provided that these children meet the basic admission requirements and enroll within the time prescribed for them.

SECTION 3.  Kindergarten-Aged Children. Conformably with RA 10157, otherwise known as the Kindergarten Education Act, children of kindergarten age, i.e., 5 years or older, shall no longer be accommodated.

SECTION 4.  Tuition and Other Fees. The prescribed monthly tuition fee from SY June 2014 to March 2015 is P800.00, provided that:

1.  Children and grandchildren of City Hall employees shall be entitled to 25% discount payable in cash or charged to their parents or grandparents through salary deduction;

2.  All children shall be entitled to 5% discount for full payment at enrolment time;

3.  All children shall pay P3,235.00 Admission Fee for uniforms, workbooks, and other school supplies and materials;

4.  Within SY 2014-2015, the Sangguniang Panlungsod shall prepare the feasibility toward full cost recovery of Montessori I and II.

SECTION 5.  Full Term Enrolment. When a child enrolls at SEED Montessori, he/she enrolls for the full term June to March.  His/Her parents must therefore pay the tuition for the full ten months even if the child discontinues attendance for whatever reason.

SECTION 6.  Effectivity. This ordinance shall take effect immediately upon its approval.
