Registration of Court Orders/Decrees and Request of Annotated Record

ABOUT THE SERVICE

Reglementary Period and Place of Registration. – (1) In case of a court decree/order concerning the status of a person, it shall be the duty of the Clerk of Court to advise the successful petitioner to have the decree/order registered in the civil registrar’s office where the court is functioning, within ten (10) days after the decree/order has become final, for Adoption thirty (30) days after the date of issuance of finality.

The following shall be recorded in the registry of court decree/order:

  • Adoption/Rescission of Adoption;
  • Annulment of marriage/Declaration of absolute nullity of marriage/Legal Separation/Court order setting aside the decree of legal separation;
  • Change of name or correction of entry;
  • Civil interdiction;
  • Declaration of presumption death of the absent spouse/Judicial Declaration of absence;
  • Compulsory recognition of illegitimate child/voluntary recognition of Minor illegitimate child;
  • Appointment of guardian/Termination of guardianship;
  • Judicial determination of filiation;
  • Judicial determination of the fact of reappearance of absent spouse, if disputed;
  • Naturalization certificate/Cancellation of naturalization certificate;
  • Separation of property/Revival of former property regime
  • Registration of foreign decree or Adoption;
  • Emancipation of orphaned minor; and
  • Other registrable court decrees/orders

REQUIREMENTS

  • Original/Certified True Copy of Court Decision/Order
  • Original/CTC of Certificate of Registration of the Court Decision/Order
  • Original/CTC of Certificate of Finality
  • Original/CTC of Certificate of Registration of the Court Decision/Order issued by the Civil Registrar where the decision/order is registered
  • Original/CTC of Decree of Nullity/Adoption

RECOGNITION OF FOREIGN DECREE

  • Judgments/orders rendered by foreign courts must be judicially confirmed/enforced by filling a civil action at the Regional Trial Courts in the Philippines (RTC-Phil.)
  • The RTC-Phil decisions must be registered in the Local Civil Registry Office of the city/municipality where the court is functioning.
  • Original or Certified True Copy of the foreign judgment or order duly registered at the City Civil Registry Office of Manila (where all foreign court orders/legal instruments are to be registered)
  • Certificate of Registration issued by the City Civil Registry Office, Manila.
  • All documents obtained in Japan and intended for use and submission to Philippine authorities must undergo consular authentication at the Philippine Embassy in Tokyo or the Philippine Consulate General in Osaka through verification of the seal and signature of a duly appointed official of the Japanese Ministry of Foreign Affairs (Gaimusho).

4. Recording of Request

Show your Official Receipt to the EIC who records the request in a logbook.

EIC record the court decree/order in the Registry Book.

For late registration – registration after the 10-day reglementary period

6. Processing

EIC prepares the annotation to the affected civil registry record &Endorsement to PSA or Record keeping Municipal/ City Civil Registry Office.

Civil Registrar signs the documents.

6. Release of Document
